Terms of Service

These Terms of Service govern your use of vibromera.com and any purchase of products or services from Vibromera (Nikolai Shelkovenko), registered in Portugal under NIF PT314539760.

1. Definitions

  • "Vibromera," "we," "us" — Nikolai Shelkovenko, Porto, Portugal.
  • "Customer," "you" — any natural or legal person placing an order through vibromera.com.
  • "Products" — physical goods listed on vibromera.com (balancing instruments, sensors, accessories).
  • "Services" — subscription plans, technical support, and marketplace listings.

2. Orders and Pricing

All prices are listed in EUR and exclude VAT unless stated otherwise. VAT is applied according to the customer’s country of residence and applicable EU or local tax rules.

An order is confirmed when payment is received. We reserve the right to cancel orders in cases of pricing errors, suspected fraud, or product unavailability — with a full refund issued promptly.

3. Payment

We accept Visa, Mastercard, American Express (via Stripe), PayPal, and bank transfer (SWIFT). Payment is due at the time of order. For bank transfers, the order is processed upon receipt of funds.

4. Shipping and Delivery

Products ship from Porto, Portugal via DHL, UPS, or EMS. Typical handling time is 1-3 business days. Delivery time depends on the destination:

  • EU: 3-5 business days
  • International: 5-10 business days
  • Remote regions: up to 2-4 weeks including customs clearance

A tracking number is provided after dispatch. All shipments are insured.

Risk of loss passes to the customer upon delivery. Customs duties, import taxes, and brokerage fees for shipments outside the EU are the responsibility of the customer.

5. Right of Withdrawal

In accordance with EU consumer protection law, you have the right to withdraw from a purchase within 14 days of receiving the goods, without giving any reason. We extend this period to 30 days as described in our Returns & Refunds policy.

6. Warranty

All products carry a 2-year manufacturer warranty from the date of delivery. The warranty covers manufacturing defects and component failures under normal use. See our Returns & Refunds page for full warranty terms.

7. Limitation of Liability

Vibromera products are professional instruments intended for use by qualified personnel. We are not liable for damages arising from misuse, incorrect installation, unauthorized modifications, or failure to follow operating instructions.

Our total liability for any claim shall not exceed the purchase price of the product in question.

8. Intellectual Property

All content on vibromera.com — including text, images, software, logos, and product designs — is the property of Vibromera or its licensors. You may not reproduce, distribute, or create derivative works without written permission.

Balanset software is licensed, not sold. The license permits installation on unlimited computers owned by the purchaser. Reverse engineering, decompilation, or redistribution of the software is prohibited.

9. Marketplace

Partners listing services on the Vibromera Marketplace are independent contractors, not employees or agents of Vibromera. Vibromera does not guarantee the quality of third-party services and is not a party to transactions between customers and marketplace partners.

Marketplace subscription terms are governed by the separate Partner Agreement.

10. Privacy

We collect and process personal data in accordance with our Privacy Policy and applicable data protection regulations (GDPR).

11. Governing Law

These Terms are governed by the laws of Portugal. Any disputes shall be submitted to the competent courts of Porto, Portugal. For EU consumers, mandatory consumer protection provisions of your country of residence apply where they offer greater protection.

12. Changes

We may update these Terms from time to time. The current version is always available at vibromera.com/terms/. Continued use of the website or placement of orders after changes constitutes acceptance.
